Madhya Pradesh HC orders status quo over land encroached by BMC, ET RealEstate
BHOPAL: A division bench of the MP high court ordered a status quo over a piece of land left vacant by the MP Housing Board (MPHB) for the residents of a colony constructed by MPHB in Aishbagh area.
This land was allegedly encroached upon by the Bhopal Municipal Corporation (BMC), the women and child development department, and the public health department of the state govt.
The person who filed the petition seeking court intervention to restore the land to the residents of the colony further alleged that the BMC was planning to use a piece of the vacant land as a dumping ground.
Nisar Khan from Bhopal, in his petition, said that the MPHB constructed a colony in the Aishbagh area, which was later transferred to the BMC for maintenance. In the area where MIG houses were built in the colony, 12,000 square feet of land was left vacant for public use. However, the BMC constructed its office on the land, and later, an anganwadi centre and an office of the health department were also opened on the land. Now, the BMC is contemplating using a portion of the land as a dumping yard.
The petitioner contended that the state govt should have allotted land for the construction of its offices elsewhere, but the land left vacant for the residents of the colony was used to open the office, which amounts to encroachment. Following the initial hearing, the bench of Chief Justice S K Kait and Justice Vivek Jain issued notices to respondents in the case while ordering a status quo.
