Telangana HC restrains GHMC, revenue officials from interfering with Banjara Hills property, ET RealEstate
HYDERABAD: Justice CV Bhaskar Reddy of the Telangana high court on Wednesday issued interim orders restraining GHMC and revenue department officials from interfering with a house property located at Road No. 12, MLA Colony, Banjara Hills.
The direction was given while hearing a writ petition filed by Buddi Prakash Toshniwal and others, who claimed ownership of the 600 square yard property. The petitioners alleged that govt authorities were attempting to dispossess them without legal justification.
Counsel L Ravichander, appearing for the petitioners, argued that officials were interfering with their peaceful possession of the property without issuing any formal notice or conducting a lawful survey. He cited Supreme Court precedents, which mandate that authorities must follow due process, including issuing prior notice, even when land is claimed by the govt.
After examining the submissions and available records, Justice Reddy directed the authorities to refrain from any physical interference with the property. The matter was adjourned for further hearing after the summer vacation.
