Madhya Pradesh HC orders status quo over cancellation of land lease at Jabalpur IT park, ET RealEstate

BHOPAL | JABALPUR: A division bench of the MP high court has ordered to maintain a status quo and issued notices to respondents in a petition challenging the cancellation of a lease of a piece of land allotted to a company for setting up a unit at IT Park on Bargi Hills at Jabalpur.

The petitioner in the case, M/s TDS Corporation, said that in 2016, Bargi Hills at Jabalpur was identified by the science and technology department of the state govt for the setting up of an IT park. The company applied for the allotment of land to set up a unit in the IT park, and it was allotted plot no. 1 by the MP Electronic Development Corporation. Promoters of the company painstakingly developed the plot to enable them to put up their unit on it. Meanwhile, there was a dispute with the owner of the neighbouring plot over the boundary of the two plots, and the company moved the court, where the case is still pending.

However, the Electronic Development Corporation cancelled the lease of the land allotted to the company on the pretext of delay in setting up the unit despite being apprised of the facts of the case. The argument was made that the project is stalled because of the case pending in the court. Following the initial hearing, the bench of Chief Justice Suresh Kumar Kait and Justice Vinay Jain ordered a status quo in the matter while issuing notices to respondents, seeking a response. Advocates Pankaj Dubey and Akshay Khandelwal appeared in the case for the petitioner.
